Data user agreement

Users of the Transloc site who use data from the database are kindly requested to cite it as follows in any report, presentation or scientific publication:

Transloc, a conservation translocation database for plants, animals and fungi in Europe and the Mediterranean. https://translocations.in2p3.fr/index.php.

Users wishing to make extensive use of the database for a specific study are invited to contact Bruno Colas (bruno.colas@universite-paris-saclay.fr and bruno.colas@agroparistech.fr) and François Sarrazin (francois.sarrazin@mnhn.fr).

Transloc users who contribute data to the database undertake to check that the data they provide can be made public. In particular, they must ensure that the public availability of the naturalist data they provide does not contravene national or local legislation. Most naturalist data is intended to be public. In France, for example, translocation data is part of the Système d’Information de l’Inventaire du Patrimoine Naturel (SINP). As such, they are open data, disseminated according to the principles of open data, i.e. free of charge, in open formats that allow them to be re-used, and in accordance with the various regulations in force on the dissemination of data (Loi Lemaire, CADA, RGPD, CRPA, Loi Valter, etc.) in all their obligations and exceptions (Bulletin officiel du ministère de la transition écologique et de la cohésion des territoires, décision du 30 août 2022). However, so-called sensitive data is an exception to the public dissemination of data and must therefore be kept confidential, in accordance with the SINP. Sensitive data is data that meets the criteria set out in article L.124-4 of the French Environment Code, the consultation or communication of which is prejudicial to the protection of the environment to which it relates. Sensitive data for the various French regions is available on the Inventaire National du Patrimoine Naturel website (https://inpn.mnhn.fr/programme/donnees-observations-especes/references/sensibilite). Similar legislation may exist in other countries within the scope of the Transloc database.

In this context, Transloc offers the possibility of transmitting certain data to the database while keeping it confidential, i.e. not visible to other users of the database (other than administrators). This includes data on the precise location of populations (GPS points), the number of translocated individuals and the post-translocation population sizes. If data other than those mentioned above cannot be made public, contributors must not insert them in the Transloc database.

With regard to personal data, Transloc complies with French legislation. Please refer to the pages ‘LEGAL NOTICES AND PRIVACY POLICY’ and ‘GENERAL CONDITIONS OF USE - GCU’. Please note that by default, contributors to the database have their first and last names listed on the pages of the populations to which they have contributed. If they do not wish this, they should write to Isabelle Baly (isabelle.baly@mnhn.fr) to anonymise their contribution. In addition, users who contribute to the database have the option of citing the organisations or individuals supplying the data. In this case, they must ensure that they have their agreement.
