GENERAL CONDITIONS OF USE - GCU


INFORMATION CONTAINED ON THE SITE

Any TRANSLOC database website data-user from the (whether accessed immediately or obtained on request) undertakes to respect the conditions of use.

Any visitor can request an extract from the database (corresponding to a taxon, a geographical area, etc.) by explaining their motivations to one of the site administrators. A contact form is provided for this purpose.

No information contained on the site can be interpreted as having any contractual value. The scientific texts published on the site are valid on the date of their publication and cannot bind their authors in the future.

The information relating to services or displaced populations or any other information contained on the site comes from documents considered reliable on the day they were put online. All information, whether practical or scientific, is of an exclusively indicative nature and without any commitment on the part of the National Museum of Natural History.

Any information contained on the site may be modified, at any time and without notice, by the National Museum of Natural History. The information contained on the Transloc site does not constitute an offer of services or products, nor a commercial solicitation of any nature whatsoever, nor a recommendation or advice. The National Museum of Natural History cannot be held responsible for any decision taken or not taken on the basis of the information contained on the site, nor for the use that may be made of it by a third party. This information cannot engage the responsibility of the National Museum of Natural History.


ACCEPTANCE AND MODIFICATIONS TO THE CGU OF THE WEBSITE

Access and use of the site are subject to acceptance and compliance with these General Conditions of Use, CGU. By browsing the site, regardless of the technical means of access and the terminals used, the user is presumed to know these GCU and accept their terms without reservation. These GCU apply, where applicable, to any variation or extension of the site on existing or future social and/or community networks.

The GCU may be modified at any time by the National Museum of Natural History. The user is therefore advised to refer before any navigation to the latest version of the GCU, accessible at any time on the site. In the event of disagreement with the GCU, the user cannot use the site's services.


PROTECTION OF SITE CONTENT

The Transloc site as well as the elements which compose it, whatever they may be, are the property of the National Museum of Natural History and are protected by copyright and intellectual property. The reproduction of all or part of this site on any paper or electronic medium is authorized only for non-commercial purposes and/or for distribution purposes for associative, informative or educational purposes, subject to compliance with the following three conditions:

The GTU may be modified at any time by the National Museum of Natural History. The user is therefore advised to refer before any navigation to the latest version of the GTU, accessible at any time on the site. In the event of disagreement with the GTU, the user cannot use the site's services.

  • free distribution;
  • respect for the integrity of the documents reproduced, i.e. no modification or alteration of any kind;
  • clear and legible citation of the source indicating the name Transloc, the internet address of the site: https://transloc-dev.in2p3.fr/ and the mention, CC-BY-4.0 UAR BBEES CNRS-MNHN 2023.

Databases and/or files are protected by special provisions, introduced by law no. 98-536 of July 1, 1998 relating to the legal protection of databases. The National Museum of Natural History guarantees that everyone is the owner of the intellectual property rights to the content posted online or has obtained the necessary authorizations from the rights holders.

It is prohibited to reuse the content without prior authorization from the National Museum of Natural History. Any distribution or use for commercial or advertising purposes of the contents and information of the site is strictly prohibited. For other intended uses, the request should be addressed to bbees@mnhn.fr.


ACCESS TO THE SITE AND USE OF THE CONTENT

The National Museum of Natural History authorizes any visitor, in compliance with these conditions and the rules of use of the Internet network, to consult this site free of charge, for simple information purposes, for personal and private use only and for exclusion of any commercial advertising. All costs related to access to the site, whether hardware, software or internet access, are the exclusive responsibility of the user.

RESPONSIBILITY OF THE USER

All hardware and software necessary for access and use of the site remain exclusively the responsibility of the user who is therefore solely responsible for the proper functioning of his equipment as well as his access to the internet.

The T&Cs may be modified at any time by the National Museum of Natural History. The user is therefore advised to refer before any navigation to the latest version of the T&Cs, accessible at any time on the site. In the event of disagreement with the T&Cs, the user cannot use the site's services.

It is therefore up to him to take all appropriate measures to protect his own data, computer systems and/or software from contamination by possible viruses. The user is solely responsible for his use of the site. The user is responsible for any damage he may cause to the National Museum of Natural History due to non-compliance with the T&Cs.

The user undertakes to inform the National Museum of Natural History without delay and by any means of any error, fault or irregularity that he observes in the use of the site, as soon as he becomes aware of it. In order to respond to a security alert (antivirus check, etc.), to the request of an authority (administrative, judicial or any authorized authority), to an alert emanating from another user, the National Museum of natural history reserves, where applicable:

  • to retain, for purposes of proof, any information that does not comply with the rules set by the GCU;
  • to keep, for purposes of proof, all logs, connection traces or data of a personal or impersonal nature proving the attributability to the user of the behaviors or actions in question;
  • to modify, refuse and/or delete access to any information that does not comply with the rules set out in these T&Cs.

The National Museum of Natural History cannot be held responsible for any damage that may be caused as a result of:

  • use of the site by the user in a manner that does not comply with these T&Cs and the regulations in force;
  • the configuration of the user's computer allowing him to identify himself automatically and thus allow any third party to use the site with his account or by usurping his identity. Consequently, to limit this risk, the user is invited to secure access to their account (deletion of cookies and automatic identification, etc.).



APPLICABLE LAW AND ATTRIBUTION OF JURISDICTION

The Transloc site is subject to French law and falls under the exclusive jurisdiction of the French courts.
